No individual supporting security can exceed $4.5 million in market value, and aggregate consumer lending with that lender cannot exceed $7 million.

Where a borrower is applying through a company, one lender's policy requires the eligible individual to be a director and a shareholder and to provide a personal guarantee. Where the entity is a trust, the eligible professional must act as trustee and provide a personal guarantee.

Another lender notes that borrowers can use a trust structure provided the eligible professional is a director or trustee. Applications involving structures that do not meet these conditions may only be assessed under a standard LMI waiver process, which may carry a lower LVR limit or stricter income requirements.

Consider a dentist who operates through a family trust and wants to buy an investment property in Dover Heights. The dentist can access an LMI waiver provided they are a trustee of the trust and provide a personal guarantee. The loan is taken in the name of the trust, but the lender relies on the individual's professional status and personal guarantee to waive LMI.

Limitations and Exclusions
